Who is responsible for securing the load?
While the German Road Traffic Act (§22) stipulates that loads must be secured in accordance with the recognized rules of technology and various standards(EUMOS 40509, DIN 55415) specify this in more detail, the German Commercial Code deals with the responsibility for this.
Load securing legal principles
While the carrier or freight forwarder is primarily liable for inadequate load securing (§§ 425/461 HGB), this does not absolve the sender or the shipper of all responsibility. If damage to the goods could not be avoided by the carrier even with the greatest care and, for example, inadequate packaging was the main reason for the damage, the carrier can be excluded from liability and this can be transferred to the sender (§§ 426/427 HGB). The following therefore applies: everyone involved in the packaging and transportation process must do their part to ensure problem-free transport.
